I found an answer to my linux sleep problem.

for reference I have a IBM T42p running Gentoo Linux

When I would put my system to sleep, it would sleep fine as long as I had a acpi_sleep=s3_bios in the kernel parms line. And come back fine as well. The only problem was if I tryed to sleep and resume when I was not in X, the screen would come back up garbled.

I found this link to an archive which specified a tool "vbetool" that could save and restore the state of the video bios. Using it I am now able to sleep and resume without a hitch whether I am in X or in a text console :)
